We have been made aware of a series of scams (see web links below) that appear to be targeting the payday loan and credit/collection industries. In these scams harassing or threatening calls have been made regarding payday and credit/collection accounts. Typically, an aggressive caller tries to scare an individual into paying by threatening jail if a portion of the alleged loan or debt is not paid immediately.
The Fair Debt Collection Practices Act (FDCPA) creates guidelines under which debt collectors may conduct business, and also defines the rights of consumers. Resurgent and its employees are committed to adhering to the FDCPA and all other applicable federal and state regulations.
If you receive a call where the caller threatens jail, physical harm, or acts in an illegal manner, and purports to be from a collection agency representing Resurgent, one of our clients, or one of our accounts, please report the conduct to us immediately at 888-665-0374.
Collectors MAY NOT:
- threaten arrest, jail or physical harm
- threaten to freeze your assets without due process
- threaten actions against a family member
- continue to call if they know you are represented by an attorney
In the event you happen to receive a call such as described above, please contact us as soon as possible at the number above and DO NOT:
- follow the instructions of the caller
- provide any financial, account or payment information
- provide any personal information
